By signing up, registering, accessing, or using the services provided by 10ALPIATTO (“Services”), users agree to comply with these terms of use, as well as the privacy policy and cookie policy published on the mobile application for Android and iOS devices named “10alpiatto” (hereinafter referred to as the “App”) and any associated website (collectively, the “Platform”).
10ALPIATTO reserves the right to modify these terms of use at any time. Any modified terms will become effective upon publication on the App and/or any associated website. Continued access to or use of the Services after such publication will be deemed as express acceptance of the changes by the user.
DESCRIPTION OF SERVICES
10ALPIATTO aims to promote culinary competitions focused on specific dishes (hereinafter “Contests”), which users of the Platform may participate in, upon registration, either as “Restaurateurs” or “Customers” (collectively, “Users”).
RESTAURATEUR
The Restaurateur, once registered, can set up their profile and view all scheduled Contests based on their geographical location. By clicking on a specific Contest, the Restaurateur can view the competition terms (such as: competition procedure, duration, pricing terms for the Customer, fees owed to 10ALPIATTO, etc.).
Each Contest allows the Restaurateur to choose among several options offered by the Platform (e.g. whether to apply a fixed price or a discount for the dish, and to select available time slots—lunch or dinner—which must meet the minimum required by 10ALPIATTO).
The Restaurateur acknowledges and accepts that the pricing offered to Customers may vary based on their level of participation, measured by the number of tastings at different restaurants. There are 3 levels: Base level – Taster (1 tasting), Intermediate – Sr Taster (2 tastings), Top level – Mr Taster (3 tastings or more).
By registering and/or participating in a Contest, the Restaurateur expressly agrees to all related conditions shown on the Platform and commits to allowing Customers to taste the competition dish at their venue during the scheduled times.
The Restaurateur can, via the Platform, modify previously selected options or cancel their participation before the Contest begins.
During the Contest, the Restaurateur must scan Customer tasting codes via the App, thereby confirming the required price or discount.
CUSTOMER
The Customer, once registered, can set up their profile and view all upcoming Contests. By clicking on a specific Contest, they can view all details, including participating restaurants and each one’s offers (e.g. fixed price or discount, competition days, etc.).
Customers can request a “tasting code,” valid for trying the competition dish at one of the competing restaurants. By registering and/or participating, Customers expressly accept all Contest terms listed on the Platform.
The Customer agrees to contact their chosen restaurant directly and book a tasting session during the available time slots. During the visit, the Customer must show their tasting code, which the Restaurateur will scan in order to apply the correct price or discount.
After tasting the dish, the Customer is required to submit a rating via the Platform. They may try additional dishes at other participating restaurants, thereby unlocking better conditions and the chance to revise previous ratings.
Multiple tastings at the same restaurant are not allowed.
SERVICE ELIGIBILITY
Access is reserved for businesses and individuals aged 18 and older.
Users must keep their login credentials secure and may not use other users’ accounts. In case of violations, 10ALPIATTO reserves the right to delete accounts and block access to the Platform. Users must provide accurate personal data and, if requested, a valid ID.
Users authorize the use and publication of their name and/or image, solely for service-related purposes.
False declarations will result in account deletion.
FEES
For each Contest, Restaurateurs agree to pay 10ALPIATTO a fee calculated by multiplying the registration fee by the number of tastings confirmed through code scans. Fees are based on scanned tasting codes, not on Customer ratings.
After each Contest, 10ALPIATTO will provide Restaurateurs with a fee report. Payment must be made before the publication of Contest results. 10ALPIATTO will issue an invoice.
Failure to pay may lead to exclusion from the Contest and account deletion, with legal action possible for fee recovery.
10ALPIATTO may grant discounts to Restaurateurs who frequently participate.
All participation costs (e.g. ingredients, utilities, rent, staff) are the Restaurateur’s sole responsibility.
Fees may vary per Contest, based on parameters chosen by 10ALPIATTO.
CONTESTS
The scheduling, content, and conditions of each individual Contest are exclusively at the sole discretion of 10ALPIATTO.
The tasting code generated by the Platform, and consequently the discount applied in favor of the Customer, is personal and valid for one single dish. During the Contest, Customers may vote for the dish tasted at the same Restaurateur only once. If the Customer fails to submit a vote by the end of the Contest, 10ALPIATTO may, at its sole discretion, issue a warning, delete the profile, or block access to the Platform. For the purposes of participating in the Contests, users are required to act with the utmost fairness, and in particular to comply with the indicated schedules and any other conditions related to their execution.
In the execution of the Contests, users are strictly prohibited from engaging in behavior that violates any laws, or that is contrary to morality and public decency.
The Restaurateur is the sole and exclusive party responsible to the Customer for any obligations arising from or in any way related to the Contest, assuming all relevant duties and rights, including allowing the Customer to taste the dish on the specified date and time, and at the agreed price or discount.
The Customer acknowledges and accepts that Restaurateurs may cancel their participation in a Contest before it begins. In this regard, the Customer irrevocably waives any and all claims.
During each Contest, the Platform constantly updates the Restaurateurs on the number of scanned tasting codes, the score achieved, and the number of votes received for the purpose of entering the final ranking. For this purpose, Restaurateurs acknowledge and accept that the number of votes required to enter the final ranking may vary based on the parameters chosen at the sole discretion of 10ALPIATTO for each Contest (e.g., based on the average number of tastings carried out at all registered Restaurateurs, the number of seats, etc.).
The Restaurateur irrevocably waives any claims against 10ALPIATTO and/or the Customers in the event of failing to reach the required number of votes to be included in the final ranking.
The Restaurateur acknowledges and accepts that only the top ten in the final Contest ranking will be publicly shown.
Restaurateurs ranking eleventh or below may request the publication of their actual ranking position on the Platform.
The Restaurateur irrevocably waives any objection and/or claim regarding the voting system adopted for the final ranking.
COUPON
Coupons are codes linked to promotions occasionally available on the Platform. Promotions may have conditions (e.g. minimum Contest participation, inviting other users). Validity periods will always be shown; expired coupons are void.
10ALPIATTO may create, revoke, or modify coupons at any time and for any user.
LIABILITY
Users expressly agree to release, indemnify and hold harmless 10ALPIATTO from and against any claim, liability, damage, loss, fine, sanction, cost and expense, including, without limitation, legal fees, arising from or in any way connected to the Contests, with the users waiving any right to claims, compensation or reimbursement of any kind.
10ALPIATTO shall not be held liable in any way or under any title for false statements made by users, failure to carry out the Contest, failure of the Restaurateur and/or Customer to participate, failure by the Restaurateur to apply the agreed price or discount in favor of the Customer, failure by the Customer to vote, the rating given by the Customer, the final ranking, and, in general, for any contractual or non-contractual damage, whether direct or indirect, to persons and/or property, arising from or in any way connected to the Contests.
In the event of violations by users of these general terms and conditions, of the terms of the individual Contests, or of any law, regulation or third-party rights, 10ALPIATTO, at its sole discretion, may issue a warning, delete the profile, and block access to the Platform. Blocked users are prohibited from creating a new profile. In any case, 10ALPIATTO reserves the right to claim any outstanding credits (for example, unpaid fees from Restaurateurs who participated in Contests) and, in general, to take any and all appropriate actions to protect its rights, including for compensation purposes.
FEEDBACK AND CONTENT
Users may post reviews regarding the Service. By registering, each user agrees that their comments may be published and/or used by 10ALPIATTO, including for promotional purposes of the Services and/or the Platform.
Reviews must be based on demonstrable facts. They must be written in a transparent and objective manner and must not include offensive or outrageous content, subject to criminal prosecution or otherwise illegal. Reviews that violate this provision will not be published or will be deleted. Reviews always constitute statements made by the author (user) and not statements provided by 10ALPIATTO.
Unjustified multiple reviews, self-reviews, and other methods that could distort the review system are prohibited.
The user agrees not to publish, upload, transmit, or otherwise make available, through the Platform, content that is unlawful, obscene, defamatory, violent, discriminatory, related to child pornography, or, in general, prohibited under applicable law and/or not suitable for a minor audience.
It is understood that any content published by the user is the sole responsibility of the user, who expressly releases 10ALPIATTO from any civil, criminal, and administrative liability, including towards third parties, arising from the dissemination of such content.
10ALPIATTO is under no obligation to monitor content published by users in advance, nor can it be held liable for any violations committed by them.
ACCOUNT DELETION
The user has the possibility to delete their account at any time directly from the Platform, by accessing the dedicated section in the profile settings. Upon deletion of the account, the user will lose access to all services offered by 10ALPIATTO linked to that account.
Regarding the processing of personal data, reference is made to the contents of the privacy policy.
INTELLECTUAL PROPERTY
All intellectual property rights related to the Contests are the exclusive property of 10ALPIATTO.
The user acknowledges and accepts that 10ALPIATTO may publish, reproduce, distribute, broadcast, communicate, modify, process and transform the Contest, by any means, in whole or in part, without any territorial limitation.
To this end, the user hereby authorizes 10ALPIATTO to use their name, image, and any other distinctive sign, including intellectual property rights and related rights.
APPLICABLE LAW AND JURISDICTION
These terms of use, and any related action and/or dispute, shall be fully and exclusively governed by the laws in force in the legal system of the Italian Republic.
For any dispute arising from the interpretation or execution of these terms of use, the Court of Rome shall have exclusive jurisdiction.
